JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 04-12-2015 The petitioner has been made an accused in Vigilance P.S.Case No.46 of 2012 dated 22.6.2012 registered under Sections 7 and 13 read with 13 (1) (d) of the Prevention of Corruption Act,1988.
On completion of investigation, a report under Section 173(2) of the Code of Criminal Procedure (for short "Cr.P.C."), was filed in the court of Special Judge, Vigilance, Patna on 17.08.2012. After taking into consideration the report submitted under Section 173(2) Cr.P.C. and the documents submitted therewith, the learned Special Judge, Vigilance, took cognizance of the offence vide order dated 22.08.2012. The aforesaid order dated 22.08.2012 was challenged by the petitioner by filing an
Patna High Court Cr. WJC No.1181 of 2015 (2) dt.04-12-2015 2/2 application under Section 482 of the Cr.P.C. before this Court vide Cr. Misc. No. 6014 of 2014, which was dismissed by a coordinate Bench of this Court vide order dated 19.08.2014. After the aforesaid order dated 19.08.2014 has been passed, the petitioner has filed the present application under Articles 226 and 227 of the Constitution of India seeking quashing of the chargesheet submitted by the police. In my opinion, the application is not only thoroughly misconceived but also an abuse of the process of the Court. Accordingly, it is dismissed.
