03-02-2016 Heard learned counsel for the petitioner and learned A.C. to Govt. Pleader - 31.

The present petition has been filed with a prayer to restore C.W.J.C. No. 22212 of 2013, which stood dismissed on 18-09-2015, due to non-prosecution.

It has been submitted that due to the reason beyond control of the learned counsel for the petitioner, on the date when case was called out, there was non-appearance and as such, the writ petition stood dismissed. The reason for non-appearance has been mentioned in paragraph - 6 of the petition.

In view of facts disclosed in the restoration petition, same is allowed.

Let C.W.J.C. No. 22212 of 2013 be restored to its original file.
