The petitioner seeks bail in a case registered for offences under Sections 399 and 402/34 of the Indian Penal Code, Sections 25(1-b)a and 26 of the Arms Act and Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. It is contended that, as per allegation, one knife and one mobile phone has been recovered from the possession of the petitioner. It is further contended that the other coaccused namely Jitendra Kumar has been granted bail by this Court vide order dated 10.08.2017 passed in Cr. Misc. No. 36377 of 2017. Considering the facts and the circumstances of the case, the petitioner, above named is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-II-cumSpecial Judge, Excise Act, Nawada in connection with Nagar P.S. Case No. 412 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
