The petitioner seeks regular bail in connection with Teghra P.S.Case No.190 of 2018 (g.r.No.2093 of 2018) registered for offences punishable under Sections 302, 34, 120B of the Indian Penal Code and 27 of the Arms Act.

Allegation against the petitioner as per FIR is that the husband of the informant was shot at the shop due to which he received injuries and taken to the hospital but he succumbed to the injuries and Bankatesh and two unknown persons have been named in the FIR and it is stated that there was dispute with respect to submersible pump as he refused to supply the same free of cost and it appears that the name of the petitioner appeared during the course of investigation.

No.58125 of 2018 (3) dt.20-11-2018 2/2 Submission of the learned counsel for the petitioner except confession of the co-accused there is nothing against him and though he is accused in two other cases but he is on bail in those cases and further he is in custody for five months. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Begusarai in connection with Teghra P.S.Case No.190 of 2018 giving rise to G.R.No.2093 of 2018.

With following conditions :

(i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall co-operate in the disposal of trial and make himself available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of his bail bond.
