JUSTICE SUDHIR SINGH ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Section 395 of the Indian Penal Code.

The allegation against the petitioner and other coaccused is that they looted loaded truck of cock feed and also snatched Rs. 10,000/- of the informant.

It is submitted on behalf of the petitioner that the petitioner is in custody since 01.01.2016.Charge sheet has already been submitted in this case. There is no allegation of tampering of the witnesses alleged against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has come on the basis of confessional statement of co-accused. It is alleged that looted feed was kept at the Gosala of the petitioner. At best

Patna High Court Cr.Misc. No.23691 of 2016 (4) dt.16-08-2016 Section 414 IPC is only attracted against the petitioner. On behalf of the State it is submitted that the petitioner is not named in the FIR.

Considering the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Muzaffarpur in Sessions Trial No. 199 of 2016 arising out of Maniyari P.S.Case No. 12 of 2016.
