Petitioner seeks bail in a case registered for the offences punishable under Sections 324, 307, 302, 201 and 436/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with others committed murder of his wife. Petitioner is in custody since 17.11.2013. The charges have already been framed in the trial on 04.02.2016. However, no prosecution witness has turned up as yet.
Considering the period already undergone by the petitioner and chances of non-conclusion of trial in near future, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two
Patna High Court CR. MISC. No.57231 of 2018(5) dt.25-04-2019 2/2 sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No. 227 of 2015/21 of 2016 arising out of Marauna Police Station Case No. 127 of 2013, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
