NILU AGRAWAL ORAL ORDER 26-10-2016 Heard learned counsel for the petitioners and learned APP for the State.
Petitioners apprehend arrest in connection with Sabour (Goradih) P.S. Case No. 71/16 for offences alleged under Sections 304-B, 120-B/34 of the Indian Penal Code. Allegation is that for non-fulfillment of demand of dowry all the in-laws people including the petitioners killed the daughter of the informant.
It has been submitted by the learned counsel for the petitioners that they are father-in-law, mother-in-law and gotni respectively of the deceased and are living separate from the husband of the deceased. He submits that the husband is in
Patna High Court Cr.Misc. No.45346 of 2016 (2) dt.26-10-2016 2/2 custody and there is no specific allegation against these petitioners.
However, learned APP for the State submits that the petitioners are named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, since the husband is already in custody, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of eight weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial MagistrateX, Bhagalpur, in connection with Sabour (Goradih) P.S. Case No. 71/16, subject to the conditions as laid down under Section 438(2) Cr.P.C.
