The petitioners are apprehending their arrest in a case registered under Sections341, 323, 326(A) and 307/34 of the Indian Penal Code.
Allegation is that the accused persons including the petitioners caused serious injuries to the son of the informant by pouring acid on his body and thereafter they pressed the neck with intent to kill him.
It has been submitted on behalf of the petitioner that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. There
Patna High Court Cr.Misc. No.51349 of 2016 (3) dt.23-12-2016 2/2 is no injury report in the case diary to support the allegations made in the F.I.R. The matter has been compromised vide Annexure-2 to the present application.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Shri Raghubansh Narayan, Additional Chief Judicial Magistrate-3rd, Araria in connection with Palasi P.S. case No.182 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
