JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-07-2019 This is an application for grant of anticipatory bail in connection with Piro Mahila P.S. Case No. 08 of 2019, disclosing offences under Sections 498A, 379, 34 of IPC and Section 3⁄4 of Dowry Prohibition Act.
Prosecution story is that informant was married with the petitioner and thereafter, she was taken away to Pune by the petitioner, where the accused persons including the petitioner started demand of 30 grams of gold and they used to assault her and closed her in the house. It is also stated that father-in-law has bad eyes upon her and used to enter in her room and lastly, she was ousted from the house.
Submission of the learned counsel for the petitioner is that the whole allegations are false and concocted. He is still ready to

No.42671 of 2019(2) dt.10-07-2019 2/2 keep her with full dignity and care and the said ground has also been taken by the petitioner before the learned Sessions Judge but the informant refused to reside with him on the ground that petitioner has already married with another lady. Further submission is that he has already disclosed the fact that he was taken divorce from his first wife but in spite of that informant is not ready to reside, making same allegation not only against him but also against his father. It has also been submitted that there is no specific allegation has been attributed against him.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Ara, in connection with Piro Mahila P.S. Case No. 08 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
