1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Pipariya P.S. Case no.68 of 2024, registered under sections 137(2), 140(3) of Bhartiya Nyaya Sanhita, 2023.

As per the prosecution case, the informant states that the accused persons including the petitioner herein took his son from Lakhisarai, which information was given by his son on telephone to his wife. He was taken to Rampur. After sometime, the mobile phone of his son was discovered to be switched off. The informant states that the accused persons had threatened him and as such he suspects that they had killed his son.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.40709 of 2025(3) dt.15-10-2025 2/3 petitioner has been falsely implicated in the case. There is no eye witness to the alleged occurrence. The only material against the petitioner is the confessional statement of co-accused Manish Singh and Niwas Singh made before the police. The petitioner has no reason to commit the alleged crime. He has no criminal antecedent. It is finally submitted that even so far as the contents of the confession is concerned, the same does not support the prosecution case nor the findings in the postmortem report.

The application for anticipatory bail is opposed by learned A.P.P. for the State who submits that the confession of Manish Singh and Niwas Singh are recorded in paragraph nos. 45 and 46 of the case diary where they have confessed to the killing of the son of the informant in which the petitioner is also said to have participated and the said confession has led to recovery of the dead body.

Having heard learned counsel for the parties and taking into consideration the material that has transpired in course of investigation especially the confession of the coaccused recorded in paragraph nos. 45 and 46 of the case diary wherein the petitioner is said to have participated in the occurrence and the said confession leading to recovery of the
Patna High Court CR. MISC. No.40709 of 2025(3) dt.15-10-2025 3/3 dead body of the son of the informant, the Court is not inclined to enlarge the petitioner on anticipatory bail and application is rejected.
7. The petitioner is directed to surrender in the learned Court below within a period of four weeks.
