This application is for grant of regular bail in connection with Madhepur P.S.Case NO.116 of 2017 dated 4.12.2017 giving arise to S.T.No.158 of 2018 for the offences under Section 302 of the Indian Penal Code.
Allegation against the petitioner is that he came in the drunken condition and started abusing the informant and when her husband protested he was assaulted by sharp cutting weapon due to which he received several cut injuries on the chest and other parts of the body and when she tried to save him, she was also assaulted by the petitioner and later on husband of the informant died due to the aforesaid injuries.
Submission of the learned counsel for the petitioner
Patna High Court Cr.Misc. No.57093 of 2018 (3) dt.02-11-2018 2/2 is that he has been falsely implicated in this case and the informant is not eye witness of the occurrence and he is in custody since 4.12.2017.
Heard learned A.P.P. also, who has opposed the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since the petitioner is in custody, the learned trial court is directed to expedite the trial. With the aforesaid observation, this application is dismissed.
