JUSTICE ARUN KUMAR ORAL ORDER 21-09-2017 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Singheshwar P.S.Case No. 129 of 2017 registered under Sections 392 and 411 of the Indian penal Code. Allegation in brief is that four boys robbed the informant's motorcycle and mobile and on alarm raised by the informant, out of four boys, two were apprehended at the spot by the local people.

Submission is that petitioner was a passer-bye and nothing has been recovered from his possession and he has got clean antecedent whereas from perusal of the FIR itself, it appears that Micromax mobile and motorcycle were recovered from another co-accused Praduman Kumar Yadav who got the

Patna High Court Cr.Misc. No.43470 of 2017 (2) dt.21-09-2017 2/2 seizurelist, and recovery of mobile shown from the possession of the petitioner but the copy of the seizurelist has not been given to him rather only signed by Praduman Kumar Yadav and this petitioner has got no criminal antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Sawan Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Madhepura in connection with Singheshwar P.S. Case No. 129 of 2017.
