The petitioner apprehends his arrest in connection with Paras Bigha P.S. Case No. 39 of 2015 registered under Sections 147, 148, 149, 323, 325, 504, 307, 354, 448 and 435 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that there is general allegation against the petitioner and 12 others to set on fire the Baithka of Meera Devi, wife of Nand Banjara and causing injury to Meera Devi, Meena Devi, Santosh Kumar and Mukesh Kumar through lathi, khanti and iron rod. In fact, in the occurrence petitioner's side also sustained injuries regarding which Paras
Patna High Court Cr.Misc. No.44572 of 2016 (2) dt.28-10-2016 2/2 Bigha P.S. Case No. 40 of 2015 was instituted under Sections 147, 323, 504, 354 and 307 of the I.P.C. on the basis of the written report of co-accused Yugeshwar Das. Further submission is that Yugeshwar das and 9 others have already been allowed anticipatory bail by a Bench of this Court vide Cr. Misc. No. 13199 of 2016 on 01.04.2016.
Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the J.M., 1st Class, Jehanabad in connection with Paras Bigha P.S. Case No. 39 of 2015, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Rajendra Kumar Mishra, J) Shail/- U T
