2. Petitioners apprehend arrest in a case registered for the offence punishable under Sections 30 (a) , 32(3) of the Bihar Prohibition and Excise Act.

3. Prosecution case is that 174.6 liters of illicit foreign liquor were recovered from scorpio in question .

4. It is submitted that the petitioners are innocent and have falsely been implicated in this case . Petitioners are neither owner nor driver of the alleged vehicle . No incriminating material has been recovered from the conscious possession of the petitioners.

5. Learned counsel for the State submits that petitioners have got three criminal antecedent of similar nature .

6. Considering the fact that petitioners have got three criminal antecedent of similar nature , his prayer for anticipatory bail is rejected.
