JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
Petitioner is apprehending his arrest in a case registered for offences punishable under Sections 147, 148, 149, 323, 324, 307 and 504 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that there is case and counter case between the parties. The only allegation against the petitioner is that he has given knife blow to the informant but the said blow has not caused any serious injury. Heard learned A.P.P. also Considering the facts and circumstances of the case and submissions advanced, the petitioner is directed to surrender before the Court below within a period of four weeks from today
Patna High Court Cr.Misc. No.51026 of 2016 (2) dt.19-12-2016 2/2 and if he does so, his prayer for bail will be considered by the learned Court below after considering this aspect that the injuries caused to the informant is simple in nature and after verifying the case diary, shall dispose of the matter on very same day, without being prejudiced by the order of this Court.
