2. The petitioner is in custody in connection with Raniganj P.S Case No. 336 of 2023 registered for the offences punishable under Sections 302, 201/34 of the I.P.C.
3. As per prosecution case, the allegation against the accused persons including petitioner is that they have committed murder of the informant's sister namely, Ranju Devi.
4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is further submitted that there is no eye witness of the incident who has stated against the petitioner. Petitioner is married sister-in-law of the deceased. It is also submitted that there is general and omnibus allegation against all the F.I.R named accused persons including the
Patna High Court CR. MISC. No.45471 of 2024(3) dt.08-10-2024 2/2 petitioner and there is no any specific overt act has been alleged against the petitioner. It is next submitted that petitioner is in judicial custody since 28.04.2024 and she has got no criminal antecedent as stated in para 3 of the bail petition.
5. However, learned APP for the State oppose the prayer for regular bail of the petitioner.
6. Considering the all aspects of this case, statement of the witness under Section 161 of the Cr.P.C and submissions made on behalf of the petitioner, let the above named petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Araria in connection with Raniganj P.S Case No. 336 of 2023.
