The petitioner apprehends his arrest in connection with Runnisaidpur P.S. Case No.195 of 2015 registered under Sections 420, 467, 468, 409, 406 and 120B/34 of the Indian Penal Code. The accusation is that, in course of inquiry by the Executive Magistrate, Sitamarhi (Sadar), several irregularities, in respect of the withdrawal of Government Fund and issuance of Revenue Certificate, were found at the level of PACCS Chairman and Circle Officer of Runnisaidpur Circle.
Learned counsel for the petitioner submits that, admittedly, the petitioner is the Circle Inspector of Runnisaidpur
Patna High Court Cr.Misc. No.36458 of 2016 (2) dt.02-09-2016 2/2 Circle and he had simply forwarded the report of the Halka Karmchari for issuing certificate to the Circle Officer, who issued the same. As such, the petitioner cannot be held responsible for the said act. Further submission is that Halka Karmchari, Jai Narain Sah, has already been granted anticipatory bail by this Court vide order dated 24.07.2015 passed in Criminal Misc. No.28396 of 2015.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sitamarhi, in connection with Runnisaidpur P.S. Case No.195 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C.
