The petitioner is languishing in custody since 23.04.2018 in a case registered for the offences punishable under sections 341,323,504,506,387,386,34 of the Indian Penal Code.

The prosecution case got initiated on the basis of written report dated 12.11.2017 submitted by Ravi Ranjan Kumar to the Station House Officer, Police Station is to the effect that on 11.11.2017 at 11.30 P.M., nine unknown accused persons came on three motorcycles on the construction site

Patna High Court Cr.Misc. No.58293 of 2018(4) dt.07-01-2019 2/3 and they assaulted the informant and asked him to pay extortion, otherwise to stop the construction work, leading to registration of FIR against unknown. The name of the petitioner sprang up during investigation.

It is submitted by learned counsel for the petitioner that there is no direct evidence collected against the petitioner during investigation and the petitioner has been roped in the present case on the basis of suspicion. Though the petitioner is accused in ten other cases, in eight out of the ten cases, he is on bail. A statement to the effect has been made in paragraph no.3 of the petition.

Learned APP for the State submits that the petitioner has serious criminal antecedent.

Considering the suspicious nature of accusation, let the above named petitioner be released on bail, on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, Madhubani in connection with Ghoghardiha P.S. Case No. 116 of 2017, pending before the learned ACJM, Jhanjharpur, Madhubani.

Since the petitioner has serious criminal antecedent, learned court below will be at liberty to cancel the bail bonds of
