JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the parties.
The petitioner apprehends his arrest in Ujiarpur P.S. case no. 35 of 2014 for the offences under Section 406 of the Indian Penal Code and Section 138 of the Negotiable Instrument Act.
Learned counsel for the petitioner submits that the allegations are concocted and the dispute is of a civil nature. Having regard to the facts and circumstances of the case, if the petitioner deposits a sum of Rs.15,000/- within a period of one month, in the event of arrest or surrender before the court below within four weeks from today, the above named petitioner be released on bail on furnishing bail bond of Rs.5000/-
Patna High Court Cr.Misc. No.43656 of 2015 (2) dt.13-10-2015 2 / 2 (Five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Samastipur in connection with Ujiarpur P.S. Case no. 35 of 2014 subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The sum so deposited would be subject to the result of the case.
