JUSTICE RAVI RANJAN ORAL ORDER 16-08-2016 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 143, 341, 323, 354, 354(A) (iv), 506 and 506 of the Indian Penal Code. It is contended on behalf of the petitioner that, as per allegation, about six persons including the petitioner encircled the informant on 5.06.2016 at about 6.30 A.M. and assaulted and abused her and pulled her 'dupatta'. When she raised alarm, people of that locality came there.

Thereafter, when complain was made before their guardian then they assured that they would not repeat the said occurrence. However, again on 6.06.2016 at about 4.00 P.M., they came to the house of the informant and started slapping her and her mother and abused them and acted in obscene manner. When the people of that locality assembled there, they fled away.

No.31264 of 2016 (3) dt.16-08-2016 2/2 the parties as a complaint case was filed against the uncle and cousin brothers of the informant being Complaint Case No.497/2015 in which petitioner and his father have stood as witness and that apart cousin brother of the informant, namely, Mallu Singh had already lodged F.I.R against the petitioner and his family members being Dumraon P.S. Case No.166 of 2015. It is urged that the petitioner is a student of Intermediate and there is no other case pending against him except the present one and another which was filed on earlier occasion as stated above in which he is on bail.

Having regard to the facts and circumstances of the case, let the petitioner, namely, Jitesh Kumar Singh @ Jitesh Singh be released on bail in the event of his arrest/surrender before the court below within a period of six weeks from today in connection with Dumraon (Naya Bhojpur) P.S. Case No.154 of 2016, on furnishing bail bond of Rs.10,000 (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Buxar subject to the conditions as laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
