Heard the parties.
Petitioner seeks bail in a case registered for the offences punishable under Sections 419, 420, 467, 468, 471, 406, 120(B) and 34 IPC.
This matter has been taken up for out of turn hearing as two minor children aged about 2 1⁄2 years and 04 years of the petitioner are out of jail and there is no one in the family to take care.
The allegation is of embezzlement of public money meant for different Govt. Schemes.
Submission is that the petitioner, who is a female, was at that time, Chief Councilor. The inquiry report at page-19
Patna High Court CR. MISC. No.53235 of 2021(2) dt.28-10-2021 2/3 would reveal that on measurement and on inquiry from the local people, it revealed that construction work of the road was made in the past, however, construction was shown of the period 2019-20.
Submission is that without verifying whether any construction of the said road was made in the past only on the vague information, wrong inquiry report has been submitted. Moreover, the petitioner had no role in measurement of the work done by the contractor nor the petitioner had issued cheque. Only the petitioner is responsible for taking policy decision by the Committee. Petitioner is in custody since 18.06.2021.
Considering the submission aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sasaram Town P.S. Case No.156 of 2021 with following conditions: (a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to
Patna High Court CR. MISC. No.53235 of 2021(2) dt.28-10-2021 3/3 cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
