JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-10-2015 Heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest, as they have been summoned under Section 319 of the Cr.P.C., in Hathauri P.S. case no. 80 of 2002.
It appears that there is general and omnibus allegations against more than 14 persons for committing assault on the family members of the informant on account of which one Taleshwar Paswan died. Final form was submitted in favour of the petitioners. Being aggrieved, even the quashing application filed by the informant against non-summoning of the petitioners, in whose favour final form was submitted, too was rejected.

No.43667 of 2015 (2) dt.13-10-2015 2 / 2 Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below within four weeks from today the above named petitioners be released on bail on furnishing bail bond of Rs.5000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge, Muzaffarpur in connection with Hathauri P.S. Case no. 80 of 2002, Tr. No. 444 of 2002, subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the condition that the petitioners would not physically absent for two consecutive dates at stretch till four witnesses are examined.
