2. This appeal has been preferred against the order dated 21.05.2025 passed by the learned 1st Additional Sessions Court-cum- Special Judge, Siwan in S.Tr. No. 71 of 2024 arising out of Panchrukhi (Sarai OP) P.S. Case No. 09 of 2024 registered for the offence under section 302 and 34 of the Indian Penal Code and section 27 of the Arms Act and section 3(i)(r)(s) and 3(2)(va) of the SC/ST Act.

3. Earlier, the bail application of the appellant was rejected and this is the second attempt.
4. As per the prosecution story, the informant alleged that her husband along with two friends went to Paswan Tola where after some arguments between the parties, information came about the firing. Upon reaching there, it was found that Shailendra Yadav (appellant), Birendra Yadav, Santosh Yadav, Surendra Yadav, Osihar Yadav and Ajit Yadav after giving caste name abused them and later allegation is that Shailendra Yadav and Osihar Yadav opened fire causing injury to her husband/friend which proved fatal. This led to the FIR.
5. Learned Senior Counsel submits that he has remained in custody for long and if granted relief, shall be diligently appearing in trial.
6. Learned counsel representing the informant submits that the trial is at the fag end and is likely to be concluded soon.

9. Considering the allegation that has come, the trial is at the fag end, it would be appropriate that trial is taken to its logical, conclusion, accordingly the bail application stands rejected.
