JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Obra Police Station Case No. 52 of 2016 registered for the offences punishable under Sections 341, 323, 384, 420, 504/34 of the Indian Penal Code.

Petitioner is said to be compounder of one doctor Bikram Kumar. At the relevant time he was working in Aditya clinic. It is alleged that he took the informant and her family members to the aforesaid Aditya clinic and after treatment he as well as his concerned doctor demanded Rs. 20,000/- as fee and when the aforesaid demand was not fulfilled, they assaulted the informant and her family members.

Patna High Court Cr.Misc. No.45016 of 2016 (3) dt.20-12-2016 2/2 Submission on behalf of the petitioner is that petitioner was servant of the doctor Bikram Kumar and, as a matter of fact, the informant implicated the petitioner in this false case on account of previous enmity and dispute. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs. 10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of the SubDivisional Judicial Magistrate, Daudnagar, Aurangabad in Obra Police Station Case no. 52 of 2016, subject to condition as laid down under Section 438(2) of the Cr.P.C.
