Petitioner seeks bail in Nawgachia P.S. Case No.149 of 2016 instituted for the offence under Section(s) 147, 148, 149, 302, 120(B) Indian Penal Code and Section 27 of Arms Act pending in the Court of learned Additional Chief Judicial Magistrate-II, Nawgachia, Bhagalpur.
It has been alleged that this petitioner along with other accused persons have made indiscriminate firing after surrounding brother-in-law of the informant on account of which he died on the spot.
Case diary has been received, wherein, post mortem report is available. Learned APP has submitted that in post
Patna High Court Cr.Misc. No.59308 of 2018 (4) dt.06-10-2018 2/2 mortem report doctor has found total fourteen (14) injuries of fire arm on the person of deceased. All the injuries are either wound of entry or wound of exit on vital part of body. From para 3 of the bail petition, it appears that petitioner has criminal antecedents.
In view of such, this Court is not inclined to enlarge the petitioner on bail.
Prayer of the petitioner for grant of bail is rejected. It has been submitted that trial in the Court below has started.
The Court below is directed to expedite the trial. Liberty is given to the petitioner to renew the prayer for bail after six months, if no substantial progress is made in trial.
