JUSTICE ASHWANI KUMAR SINGH ORAL JUDGMENT Date: 03-08-2016 In the present application preferred under Section 482 of the Code of Criminal Procedure, the challenge is to the order dated 05.12.2011 / 07.12.2011 passed by the learned Judicial Magistrate-1st Class, Patna in Complaint Case No. 1913(C) of 2011 by which the cognizance of the offences punishable under Sections 406 and 420 of the Indian Penal Code has been taken and the petitioners have been summoned to face trial.

The complainant has supported the allegations made in the complaint in his statement made on oath. Apart from the complainant, three other witnesses were also examined in course of inquiry conducted under Section 202 of the Code of Criminal Procedure who have also supported the allegations made in the complaint.
In that view of the matter, if the learned Magistrate has summoned the petitioners to face trial for the offences punishable under Sections 406 and 420 of the Indian Penal Code, no illegality can be found with the impugned order. Accordingly, the application, being devoid of any merit, is dismissed.
