2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 27(c), 28 and 28(A) Drugs and Cosmetics Act, 1940.
3. It is alleged that this petitioner and his brother were indulged in the business of selling of spurious drugs.
4. It is submitted that during inspection Powrin tablet was not seized from the shop of the petitioner. Petitioner has no knoledge about the selling or purchasing of powrin tablet from his shop ( the M/s Saraswati Medial hall ) and it is manifest from the inspection report that the alleged drug was not seized from the shop in question. Petitioner claims clean antecedent.

5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J . M. 1st Class, Buxar in connection with Complaint Case No . 12(O) of 2011 , subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
