JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioner apprehends his arrest in connection with Manjhagarh P. S. Case No. 43 of 2019 registered under Sections 323, 324, 341, 498A and 504/34 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.
Petitioner is husband of O.P. No. 2. There is marriage discord between the parties.
Heard learned counsel for the petitioner as well as learned counsel appearing on behalf of O.P.No. 2.
Learned counsel for the petitioner submits that both parties have amicably settled their dispute out of Court and a sum of Rs. 8 lacs has been paid by the petitioner to O.P.No. 2 i.e, to his wife.
Patna High Court CR. MISC. No.40595 of 2019(5) dt.04-11-2019 2/2 Learned counsel appearing on behalf of O.P.No. 2 endorses the submission made by learned counsel for the petitioner.
Having heard learned counsel for the parties and taking into consideration the fact that both parties have amicably settled their dispute outside Court, I am inclined to grant anticipatory bail to the petitioner.
Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Gopalganj in connection with Manjhagarh P.S.Case No. 43 of 2019; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
