JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 19-08-2017 Heard learned counsels for the petitioners and State The petitioners are accused in Andhra Math P.S. Case No. 48 of 2017 for the offences under Sections 363 and 365 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added.
From the perusal of the F.I.R. it appears that the informant has alleged that his daughter was forcibly kidnapped by unknown and took her on a motorcycle.
Mr. Rama Kant Sharma, learned senior counsel appearing on behalf of the petitioners submits that the petitioners are the cousin brother of the alleged victim and they have been roped in this case without any material, even the informant of the
Patna High Court Cr.Misc. No.38325 of 2017 (2) dt.19-08-2017 2/2 case, as per annexure-2, has indicated that the police has wrongly implicated the cousin brother and is not taking action against the real culprit In the peculiar facts and circumstances, the court is inclined to grant bail to the petitioners on the condition that the informant, who is the author of Annexure-2, is one of the bailors in this case. Let petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur or the successor Court in connection with Andhra Math P.S. Case No. 48 of 2017, subject to the condition that the petitioners will extend full cooperation in the conclusion of the trial and will not, in any manner, tamper with the evidence or influence the witnesses.
