The present case arise out of Azam Nagar (Salmari O.P.) P.S. Case No. 115 of 2021 lodged on 17.5.2021 for the offences under sections 363, 365/34 of the Indian Penal Code by the informant Bikram Ravi Das.

As per the allegation, his three years old son was playing outside his home and suddenly he disappeared. Search was made and when they failed to locate their child, FIR was lodged alleging that one Heena Devi and Munna Sah may be behind the said kidnapping.

Learned counsel for the petitioner submits that the allegation has been levelled against Heena Devi and Munna Sah

In this case, case diary was called for. The learned APP has gone through the same and has attributed to this Court's notice to different paragraphs wherein it has been found that the petitioner herein along with Heena Devi was taking the minor boy.

Considering the fact that three years minor boy was kidnapped by Heena Devi with active participation of the petitioner herein, this Court for the present is not inclined to grant him any relief and the bail application is hereby rejected. The trial court is directed to expedite the trial and conclude the same at an earliest.
