JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 19-09-2017 Heard learned counsel representing the petitioner as well as learned A.P.P. for the State.

The petitioner is seeking regular bail in Gaya Rail P.S. Case No. 229 of 2017 registered under Section 374 of the Indian Penal Code and Section 26 of the Juvenile Justice Act. Learned counsel for the petitioner submits that the petitioner has been arrested and is in custody since 03.08.2017 on the allegation that he was taking away the minor children named in the F.I.R. for work outside his place of residence. Learned counsel submits that the petitioner is innocent and in fact on the request of the parents of the children he was taking them away to their respective parents. He further submits that one of the boys named in the F.I.R. is major as his age, as per the Aadhar Card, is about 22 years.

Patna High Court Cr.Misc. No.44461 of 2017 (2) dt.19-09-2017 2/2 Learned A.P.P. for the State though opposed the prayer for regular bail but submits that the alleged occurrence is also the result of poverty.

In the facts and circumstances of the case, let the petitioner, namely, Md. Zeeshan @ Md. Zishan @ Zishan Alam, be released on bail on his furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Railway, Gaya in connection with Gaya Rail P.S. Case No. 229/2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
