The petitioner seeks bail in anticipation of his arrest in connection with Azamnagar (Salmari O.P.) P.S. Case No. 124 of 2020 instituted for the offences under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code.
Though the petitioner is said to have assaulted three persons some of whom have received simple injuries but learned counsel for the petitioner has submitted that there is a counter version of the occurrence also. Three
Patna High Court CR. MISC. No.39628 of 2020(2) dt.02-06-2021 2/3 persons from the side of the petitioner also have been injured about which there is no reference in the subject F.I.R. Precisely for this reason, it has been argued that the informant of this case has not come clean with all the facts before the police. Apart from this, it has been submitted that the petitioner and the informant are in dispute with respect to a property and they are agnates as well.
The petitioner is stated to be a college student and he is said to have been made accused in this case with the sole purpose of jeopardizing his academic career.
Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the Court below within a period of eight weeks from the date of receipt/ production of a copy of this order, on furnishing bail bonds of Rs.10,000/- (Rs. Ten Thousand) each with two sureties of like amount to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Azamnagar (Salmari O.P.) P.S. Case No. 124 of 2020, subject to the condition laid down under Section 438(2) of the Code of
Patna High Court CR. MISC. No.39628 of 2020(2) dt.02-06-2021 3/3 Criminal Procedure.
