====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 24-06-2021 Heard Mr. Nawal Kishore Singh, the learned Advocate for the petitioners and Mr. Tarun Prasad Mandal, the learned APP for the State.

The petitioners seek bail in anticipation of their arrest in connection with Daraundha P. S. Case No.02 of 2020, instituted for the offences under Sections 147, 148, 149, 341, 323, 307, 447 of the Indian Penal Code.

The father of the informant is alleged to have been assaulted by the accused persons. Some other persons from the side of the prosecution have also been assaulted. The learned counsel for the petitioners has submitted that the parties are agnates and have been at loggerheads with respect to a plot of land.

Some of the other accused persons of this case

Patna High Court CR. MISC. No.347 of 2021(2) dt.24-06-2021 2/2 having similar accusation against them have been granted anticipatory bail.

Out of three injuries suffered by the father of the informant, two are reported to be simple, but one has been shown to be grievous, but that is not attributable to the petitioner.

Regard being had to the afore-stated facts and taking into account that the petitioners have no criminal antecedents, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri R. S. Pandey, learned Judicial Magistrate, 1st Class, Siwan in connection with Daraundha P. S. Case No.02 of 2020, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
