JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 16-02-2022 Heard both the parties through video conferencing. The petitioner seeks bail in anticipation of his arrest in connection with Shahpur Patori P.S. Case No.116 of 2020 instituted for the offences under Sections 272/273/34 of the Indian Penal Code & Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Taking into consideration that co-accused Yashwant Ray has been granted anticipatory bail and prima facie no case under 30(a) of the Excise Act is made out against the petitioner, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
