1. Heard learned counsel for the petitioners as well as learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 366(A) and 34 of the IPC in connection with Gogari P.S. Case No.448 of 2023.

3. The learned counsel for the petitioners submit that petitioners are persons with clean antecedent and the informant alleges that on 24.11.2023 in between 4-5 AM when her daughter had gone out of the house, Sonu along with the

Patna High Court CR. MISC. No.46698 of 2024(2) dt.08-08-2024 2/3 petitioners and five unknown accused abducted her on a motorcycle and when informant protested he was threatened.

4. The learned counsel submits petitioners being mother and father of Sonu came to be implicated. It is also submitted victim was in love with Sonu and she eloped with him and went to Ahmadabad where they performed their marriage. It is next submitted that from perusal of the order impugned, it would manifest that the same also records that the victim in her statement recorded under Section 164 Cr.P.C. has stated that she had gone to Ahmadabad on her own and had married Sonu.

5. The learned APP opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on anticipatory bail on their furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in connection with Gogari P.S. Case No.448 of 2023, subject to the conditions laid down under

Patna High Court CR. MISC. No.46698 of 2024(2) dt.08-08-2024 3/3 Section 438(2) of the Cr.P.C.

7. The application stands allowed.
