The sole petitioner, who is in custody since 17.5.2017 in Rampur P.S. Case No. 18 of 2017 registered for the offence under Section 30(a) of the Bihar Excise Amendment Act , 2016 ( hereinafter referred to as "Excise Act") has prayed for grant of bail .

It was submitted by learned counsel for the petitioner that nothing was recovered from conscious possession of the petitioner or from his house or land but even then petitioner has been made accused. It has been argued that without any recovery falsely petitioner has been made accused since petitioner was made accused in relation to commission of

Patna High Court Cr.Misc. No.43126 of 2017(2) dt.19-09-2017 2/2 offence in Excise Act earlier.

Considering the nature of accusation and period of custody, let the petitioner Bullu Manjhi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Excise Court, Gaya/ concerned court in connection with Rampur P.S.
