The petitioners are apprehending their arrest in a case registered under Sections 147, 148, 149, 323, 337, 353, 427, 283, 332, 307, 504 of the Indian Penal Code, 3 and 4 of Damage to Property Act and 151 of the Railways Act.
The prosecution case, in short, is that the accused persons were raising slogans against the police and administration and later started pelting stones due to which some constables received injuries.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no
Patna High Court Cr.Misc. No.60383 of 2018(3) dt.20-11-2018 2/2 allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. There is no substantive evidence to suggest the implication of the petitioners in the present case. Altogether 27 persons along with 300-400 unknown persons were named in the F.I.R. General and omnibus allegation has been made against the petitioners.
On behalf of the State, it is submitted that the petitioners are named in the F.I.R./complaint case. Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Hilsa, Nalanda in connection with Hilsa P.S. Case No. 361/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
