2. The petitioner seeks regular bail in connection with Raniganj P.S. Case No. 107 of 2021 registered for the offence under Sections 147, 148, 149, 341, 323, 302 and 504 of the Indian Penal Code.

3. As per the prosecution case, the allegations against the petitioner and other accused persons is of assaulting the deceased and killing him.

4. Learned counsel for the petitioner submits that there is general and omnibus allegation against the accused persons and out of seven, five accused persons have been granted bail by this Court.

5. It has next been submitted by the learned counsel for the petitioner that the charge-sheet of the present case was submitted on 17.10.2024 and that the trial is not progressing.

6. It has been further submitted by the learned counsel for the petitioner that the petitioner is innocent and has committed no offence. The petitioner is in custody since 23.04.2024.

7. Learned APP appearing for the State opposes the prayer for bail of the petitioner.

8. Considering the period of custody and the delay in trial and the fact that similarly situated co-accused persons have been granted bail by this Court, this bail application is allowed.

9. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District and Additional Sessions Judge-IV Araria/concerned Court below, in connection with P.S. Case No. 107 of 2021.

10. It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not
