JUSTICE SANJAY PRIYA ORAL ORDER 02-11-2018 Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant. The petitioner seeks bail in Katihar Town P. S. Case No. 974 of 2017 instituted for the offence under Section 307 and 302/34 of the Indian Penal Code In the written report, it is alleged that on the date of occurrence, this petitioner called the brother of the informant, namely ,Pramod Singh and thereafter he heard the sound of cry of his brother. The informant came out from his house and saw that co accused Anil Sandilya, Sonu Sah and two unknown accused persons have caught hold his brother and this petitioner along with, Bhola Biswas and Bhola Singh have caused injury with gupti to the brother of the informant and thereafter on hulla all the accused persons fled away after leaving the brother of the

Patna High Court Cr.Misc. No.59431 of 2018(3) dt.02-11-2018 2/2 informant. The brother of the informant was taken to Sadar Hosptial, Katihar where he was declared dead. Case diary has been received, wherein, postmortem report of the brother of the informant is available. The doctor has found total five deep incised injury on the abdominal cavity of the deceased.

Learned counsel for the petitioner has submitted that prayer of bail of the two other co- accused, namely, Bhola Bishwas and Bhola Singh have already been rejected by coordinate Bench of this Court by order dated 20.9.2018 and 12.9.2018 passed in Cr. Misc. no. 47252 of 2018 and Cr. Misc. no. 56834 of 2018. Therefore, this Court is not inclined to grant bail to the petitioner at this stage. The prayer for bail of the petitioner stands rejected.

The co-ordinate Bench of this Court vide order dated 12.9.2018 passed in Cr. Misc. no. 56834 of 2018 has given observation to conclude the trial within a period of nine months from the date of receipt/production a copy of this order.
