The petitioner seeks bail in anticipation of his arrest in connection with Ara Muffasil P.S. Case No.83 of 2021 instituted for the offences under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that recovery of 20 litres of Mahua liquor has been made from the road. Learned counsel submits that the petitioner has no role to play and he cannot be said to commit any offence under section 30(A) of the Bihar Prohibition and Excise Act, 2016. Taking into consideration the circumstances as above, I am satisfied that the petitioner cannot be said to have committed any offence under section 30(A) of the Bihar

Patna High Court CR. MISC. No.52175 of 2021(2) dt.17-02-2022 2/2 Prohibition and Excise Act, 2016, I am inclined to grant benefit of anticipatory bail to the petitioner and in the event of arrest, he shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
