The petitioner apprehends her arrest in connection with Bidupur P.S. Case No.528 of 2021, registered for the offences punishable under Sections 304(B)/120(b) of the Indian Penal Code.

The petitioner, who is mother-in-law of the deceased, alongwith other co-accused persons are said to have killed the daughter of the informant for non-fulfillment of demand of additional dowry.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that there is general and

Patna High Court CR. MISC. No.42800 of 2022(2) dt.29-11-2022 2/2 omnibus allegation against the petitioner and the petitioner is mother-in-law of the deceased. It is submitted that the petitioner is aged about 88 years.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Taking into consideration the age of the petitioner, let petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No.528 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure. The learned court below is directed to verify the age of the petitioner. If it is found that the petitioner is aged about 88 years, then only the learned court below shall accept the bail bond of the petitioner.
