The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 325, 379, 504/34 of the Indian Penal Code subsequently section 307 of the Indian Penal Code was also added. It is alleged against the petitioner that in the background of land dispute he assaulted on the head of the informant with 'farsa'.

It is submitted by learned counsel for the petitioner that the injury has been found to be simple and there is no accusation of repeating the blow. The petitioner is agnate of the informant and in the background of land dispute the accusation has been levelled. Moreover, a statement has been made in

Patna High Court Cr.Misc. No.40146 of 2015 (2) dt.13-10-2015 2/2 paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Sangrampur P.S. Case No.86 of 2014, pending before the learned Judicial Magistrate, 1st Class, Sadar, East Champaran at Motihari.

With the above observation, this application is, accordingly, disposed off.
