The petitioner seeks bail in connection with Aurangabad Town P.S. Case No. 449 of 2019 registered for the offences punishable under Sections 420 and 379 of the Indian Penal Code.

The prosecution case in brief is that the informant Ramswaroop Singh @ Vijay Singh is account holder in United Bank of India, Branch-Bhowra Dhanbad, with Account No.0594010101769. He further stated that on dated 05.09.2019, Rs.20,000/-, on 07.09.2019, Rs.40,000/-, on 09.09.2019, Rs.60,000/-, on 13.09.2019, Rs.25,000/-, on 16.09.2019,

Patna High Court CR. MISC. No.39833 of 2020(3) dt.17-03-2021 2/3 Rs.10,000/-, on 19.09.2019, Rs.36,000/-, on 11.10,2019, Rs.10,000/- and on 15.11.2019, Rs.38,000/- total Rs.2,39,000/- has been withdrawn illegally by some unknown persons from his ATM Card and he came to know about the illegal withdrawal of money when he visited for verification of his account at his account holding branch.

Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. Due to suspicion, petitioner has been implicated in this case, nothing has been found from his possession nor any concrete evidence has been brought by the police against him. Learned counsel for the petitioner further submits that the informant has not lodged any complain either before the Bank or before any police station for disappearing his A.T.M. Card, A.T.M. Card has not been found or recovered from the possession of the petitioner. Petitioner is in jail custody since 22.08.2020 and petitioner has got no any criminal antecedent.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) only with two sureties of the like amount each to the satisfaction of learned
