JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-08-2016 Heard the learned counsel for the petitioner and the counsel for the State.

The petitioner, being the husband of the informant, is languishing in jail since 30.06.2016 in a case registered under Sections 498A and 379 of the Indian Penal Code and 3 and 4 of the Dowry Prohibition Act.

The basic accusation is of torture for non-fulfillment of dowry demand and getting the pregnancy terminated. The learned counsel for the petitioner submits that the petitioner admits his marriage with the informant and there is nothing to suggest the termination of pregnancy. The mother of the petitioner filed a Complaint Case No. 2662 of 2015 against the informant's side on 01.09.2015 with accusation under Sections 147, 148, 149, 323, 341, 342, 452, 427, 384, 379 and 504 of the Indian Penal Code and, thereafter, the present first information report has been filed on 02.09.2015.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing

Patna High Court Cr.Misc. No.36461 of 2016 (2) dt.23-08-2016 bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Begusarai Town P.S. Case No. 455 of 2015 to the satisfaction of the Chief Judicial Magistrate, Begusarai.
