JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-10-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,307 and 504/34 of the Indian Penal Code.

It is alleged that on the order of co accused Fulzadi Khatoon, the petitioner assaulted with farsa causing cut injury on the head of the informant, thereafter the other accused persons assaulted the informant.

It is submitted by the learned counsel for the petitioner that the petitioner is agnate of the informant and in the background of land dispute the accusation has been levelled. Though the accusation is of causing injury with farsa but the injury report of the informant suggests that the injury was caused by hard and

Patna High Court Cr.Misc. No.41922 of 2015 (2) dt.13-10-2015 2/2 blunt substance. There is counter version of the occurrence also and the petitioner side also received injury. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Muzaffarpur in connection with Maniyari P.S. Case No.159 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
