The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 366/504/506/34 of the Indian Penal Code.
According to F.I.R. Afserun, the daughter of the informant, was live-in- relationship with co-accused Md. Masud. Thereafter, some difference occurred between the two, which was reconciled and Afserun started living cordially with Md. Masud. Subsequently, she was done to death. The petitioners who are relations of Md. Masud are also under suspicion.
Patna High Court Cr.Misc. No.49857 of 2016 (3) dt.17-01-2017 2/2 Submission of the petitioner is that case-diary would reveal that there is no eyewitness of the occurrence. The petitioners have falsely been implicated as they are relations of Md. Masud.
Considering the fact that there are no material against the petitioners, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Purnea/Successor Court in connection with Routa Police Station Case No.46 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
