JUSTICE PARTHA SARTHY ORAL ORDER 10-01-2022 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner has renewed his prayed for bail in a case registered under section 307 and other sections of the Indian Penal Code.
As per the prosecution case, the petitioner is stated to have given a blow with a 'farsa' on the head of the informant leading to hair line fracture on the skull.
It is submitted by learned counsel for the petitioner that the petitioner and the informant are agnates. The petitioner has been falsely implicated in the case. The earlier application for bail of the petitioner was rejected vide order dated 27.1.2021 (Annexure-1) passed in Cr. Misc. No. 33006 of 2020. The petitioner is in custody since 15.7.2020. Patna High Court CR. MISC. No.63299 of 2021(2) dt.10-01-2022 2/2 case has concluded and there is no chance of the trial concluding in the near future.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for about 1 year 5 months, the petitioner is directed to be enlarged on bail in connection with Mashrak P.S. Case no. 17 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Saran.
