2. The petitioner seeks bail in connection with Nawada ( Nagar) P.S.Case No. 373 of 2021 registered for the offence punishable under Sections 33, 34, 36 of the Bihar Prohibition & Excise Act.

3. The petitioner is supplier of spurious liquor and because of consuming the spurious liquor one person died. Earlier, the bail application of the petitioner was rejected by this Court on 24.05.2023 because of his large number of criminal antecedents.

4. Learned counsel for the petitioner has submitted that petitioner is in custody since 29.07.2022.

5. Learned counsel for the petitioner undertakes that if

No.55102 of 2024(2) dt.31-08-2024 2/3 the petitioner is granted bail, he is ready to reside in Kolkata at the address given below:- C/o- Pappu Yadav 29/11, C.P.T Quarter Hide Road. B.N.R, South Eastern Railway, P.O South Eastern Railway, P.S Khidirpur Babu Bazar, South Port Police Station, District- Kolkata, 700043, West Bengal.

6. Considering the period of custody and also the undertaking given by the petitioner that he is ready to reside at Kolkata, this application is allowed.

7. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- ( ten thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Judge-I, Nawada/ concerned court in Nawada ( Nagar) P.S.Case No. 373 of 2021.

8. As a condition of this order, the petitioner, after being released on bail is directed to mark his attendance at Khidirpur Babu Bazar, South Port Police Station on 1st Sunday of every month. Any default of appearance at the Police Station will result in cancellation of bail bonds of the petitioner.

9. Let a copy of the order be communicated to the Khidipur Police Commissioner/ Superintendent of Police
