JUSTICE BIRENDRA KUMAR ORAL ORDER 09-01-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307 and 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. Subsequently Section 304B of the Indian Penal Code has been added.

Petitioner is married sister-in-law of deceased Priyanka Kumari. There is general and omnibus allegation against the husband and other relatives including the petitioner of commission of demand of dowry and torture for the same soon before death of Priyanka Kumari within seven years of her marriage.

Patna High Court Cr.Misc. No.48216 of 2016 (3) dt.09-01-2017 2/2 Submission of the petitioner is that the husband is already in custody. The petitioner is residing elsewhere along with her family members and just to harass, they have been roped in this case.

Considering the general and omnibus allegation, let, the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Bhojpur at Ara/Successor Court in connection with Sandesh Police Station Case No.161 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
