JUSTICE PRABHAT KUMAR JHA ORAL ORDER 13-10-2015 Heard Sri Krishna Prasad Singh, learned Senior Counsel for the petitioner and learned A.P.P. for the State. Petitioner apprehends arrest in a case registered for the offences punishable under sections 448, 324, 307/34 of the Indian Penal Code and section 27 of the Arms Act. Later on section 302 of the Indian Penal Code was added. It is submitted that the Deputy Superintendent of Police supervised the case and found accusation against the petitioner false but the Superintendent of Police, Bhagalpur has directed for further investigation about verification of name of the petitioner as Prakash Singh because later on during course of investigation petitioner has been implicated in the case by adding

Patna High Court Cr.Misc. No.31419 of 2015 (3) dt.13-10-2015 alias name with the name of the petitioner i.e. Chandan Kumar Singh @ Prakash Singh. Petitioner has got no apprehension of arrest and, as such, learned counsel for the petitioner seeks permission to withdraw this anticipatory bail application in connection with Kotwali (Barari) P. S. Case No. 780 of 2004 pending in the court of the learned Chief Judicial Magistrate, Bhagalpur.

Prayer is allowed. This anticipatory bail application is permitted to be withdrawn with liberty to file a fresh application as and when required.
